Terms of Service
These terms govern your use of Exometer, a website and API monitoring service operated by Simple Magic Software LLC (“Exometer”, “we”, “us”). By using exometer.com or app.exometer.com, you agree to them. If you use Exometer for an organization, you agree on its behalf.
The service
Exometer checks the websites and APIs you choose from several locations, records the results, and alerts you when something goes down. Exometer is invitation only and in development: features may change, and some are labeled as in development.
Your account
Keep your sign-in details secure and tell us at [email protected] if you suspect unauthorized access. You’re responsible for activity in your account and organization.
Acceptable use
- Monitor only systems you own or are authorized to monitor.
- Don’t use Exometer to overload, attack or probe systems, or to reach private networks.
- Don’t use alert channels to send messages to people who haven’t agreed to receive them.
- Don’t break the law, or try to break or get around Exometer’s security or limits.
We may suspend accounts that break these rules.
Your data
You keep ownership of the data you put into Exometer and the results we collect for you. You allow us to use it only to provide the service, as described in our Privacy Policy.
Text message alerts
Exometer Alerts sends text messages (SMS) to mobile numbers that you add as alert channels in Exometer and confirm with a one-time code. Messages are uptime alerts for your checks (a check went down, is still down or recovered, or a certificate or domain is expiring) and verification codes. How to opt in, with the opt-in form and sample messages: exometer.com/sms.
- Message frequency varies with your checks and alert settings.
- Message and data rates may apply.
- Reply STOP to cancel at any time; we’ll confirm and send no further texts to that number. Reply HELP for help, or email [email protected].
- Carriers are not liable for delayed or undelivered messages.
- Consent to receive texts is not a condition of using Exometer.
WhatsApp alerts work the same way, through WhatsApp’s own terms. See our Privacy Policy for how we handle mobile numbers.
Fees
Exometer is free during its invitation-only period. If we introduce paid plans, we’ll tell you in advance, and you won’t be charged without agreeing.
Availability
We work to keep Exometer running and alerts timely, but we don’t guarantee that the service will be uninterrupted or that every alert will be delivered. Don’t rely on Exometer as your only safeguard for critical systems.
Disclaimers and liability
Exometer is provided “as is” and “as available”, without warranties of any kind, to the extent the law allows. To the extent the law allows, we aren’t liable for indirect, incidental or consequential damages, or for lost profits or data, and our total liability is limited to the amount you paid us in the 12 months before the claim, or $100 if you paid nothing.
Ending use
You can stop using Exometer and close your account at any time. We may suspend or end access for breaking these terms, or end the service with reasonable notice.
Changes
If we change these terms, we’ll update the date above and, for significant changes, tell you by email or in Exometer. Continuing to use Exometer means you accept the updated terms.
Governing law
These terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules.
